Parts Warranty
TriStar Aerial Lift & Equipment Sales Inc. warrants each aerial work platform part manufactured for TriStar Aerial Lift & Equipment Sales Inc. to be free from defects in material and workmanship arising under normal handling, installation, use and service for a period of thirty (30) days after the date of the original shipment of said part from TriStar Aerial Lift & Equipment Sales Inc.
TriStar Aerial Lift & Equipment Sales Inc. obligation and liability under this Warranty is expressly limited to the repair or, at TriStar Aerial Lift & Equipment Sales Inc. sole option, the replacement of any part proving to be defective under proper handling, installation and normal use, free of charge, at the TriStar Aerial Lift & Equipment Sales Inc. distribution facility in New Jersey, or at an authorized repair facility as designated by TriStar Aerial Lift & Equipment Sales Inc.
Parts claimed to be defective and for which repair or replacement is desired shall be returned transportation PREPAID to the TriStar Aerial Lift & Equipment Sales Inc. at the address listed below for inspection. An accompanying warranty claim must be received with Ten (10) days of the failure. Replacement parts provided under the terms of this Warranty are for the remainder of the Warranty period applicable only to the aerial platform in which they are installed as if such parts were original components of the aerial platform.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED,
INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
ANY PARTICULAR PURPOSE, AND THE OBLIGATION AND LIABILITY OF TriStar Aerial Lift & Equipment Sales Inc. UNDER THIS WARRANTY SHALL NOT INCLUDE ANY TRANSPORTATION OR OTHER CHARGES OR THE COST OF INSTALLATION OR ANY LIABILITY FOR DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES OR DELAY RESULTING FROM THE DEFECT.
Any operation beyond rated capacity, or the improper handling, installation, use or application of the parts, or the substitution parts not approved by TriStar Aerial Lift & Equipment Sales Inc., or any alteration or repair by others in such manner as, in TriStar Aerial Lift & Equipment Sales Inc. sole judgment, to affect the equipment materially and adversely shall void this Warranty. No representative of TriStar Aerial Lift & Equipment Sales Inc. is authorized to change this Warranty in any manner, and no attempt, effort, or promise made either by TriStar Aerial Lift & Equipment Sales Inc. or by any representative of TriStar Aerial Lift & Equipment Sales Inc., to repair TriStar Aerial Lift & Equipment Sales Inc. shall at anytime change or extend the Warranty in any way. This Warranty covers only new and unused aerial work platform parts manufactured for TriStar Aerial Lift & Equipment Sales Inc. Products or parts manufactured by others are covered only by such warranties as are extended to TriStar Aerial Lift & Equipment Sales Inc. by its suppliers.
